‍"Application" refers to the Sweetreactions mobile application and web platform accessible from sweetreactions.ai

AI Limitations

Sweetreactions provides:
- AI-powered meal optimization suggestions
- Nutritional information and tips
- Food tracking and analysis capabilities
- Educational content about blood sugar management
- Community features and user-generated content

5. User Accounts and Registration
- You must provide accurate, current, and complete information during registration
- You are responsible for safeguarding your account credentials
- You must immediately notify us of any unauthorized access to your account
- We reserve the right to suspend or terminate accounts that violate these Terms

6. User Content and Data
Content You Provide
- You retain ownership of Content you submit (photos, meal descriptions, etc.)
- By submitting Content, you grant us a worldwide, non-exclusive license to use, display, and process such Content to provide the Service
- You represent that you have the right to submit such Content

Health Information
- We collect and process Health Information you voluntarily provide
- This information is used to improve our AI recommendations and Service quality
- We implement appropriate security measures to protect your Health Information
- You may request deletion of your Health Information at any time

Prohibited Content
‍You may not submit Content that:
- Is false, misleading, or promotes dangerous dietary practices
- Violates any applicable laws or regulations
- Infringes on intellectual property rights
- Contains malicious code or harmful materials

7. Subscription and Payment Terms
Free and Premium Features
- Basic features are available for free
- Premium features require a paid subscription
- App Store Subscriptions: Most subscriptions are processed through Apple App Store or Google Play Store according to their billing terms
- Direct Subscriptions: Any direct subscriptions (if offered) are charged in advance on a recurring basis
- Prices are subject to change with 30 days' notice to existing subscribers

Refunds and Cancellation
- App Store Purchases: For subscriptions purchased through Apple App Store or Google Play Store, refunds and cancellations are governed by their respective policies, not ours
- Apple App Store: Refund requests must be made directly to Apple through their support channels
- Google Play Store: Refund requests must be made directly to Google through their support channels
- Direct Purchases: For any direct purchases made through our website (if applicable), you may cancel at any time with cancellation taking effect at the end of the current billing period
- We do not have control over app store refund decisions

8. Intellectual Property Rights
- The Service, including all software, algorithms, and content, is owned by the Company
- Our trademarks, logos, and service marks are protected intellectual property
- You may not reproduce, distribute, or create derivative works without permission
- User feedback and suggestions may be used to improve the Service without compensation

13. Termination
By You
You may stop using the Service at any time and request account deletion.

Upon termination, your right to use the Service ceases immediately, and we may delete your account and data.

- WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS

‍HEALTH-RELATED LIMITATION:WE ARE NOT LIABLE FOR ANY HEALTH CONSEQUENCES, MEDICAL CONDITIONS, OR INJURIES RESULTING FROM FOLLOWING OUR RECOMMENDATIONS OR USING THE SERVICE.

15. Indemnification
You agree to indemnify and hold harmless the Company from any claims, damages, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your Content or actions that infringe on third-party rights

15. "AS IS" and "AS AVAILABLE" Disclaimer
The Service is provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its affiliates and licensors, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

16. Disputes Resolution
If you have any concern or dispute about the Service, you agree to first try to resolve the dispute informally by contacting the Company at karan@sweetreactions.com.

For any disputes that cannot be resolved informally, you agree that such disputes shall be resolved through binding arbitration in New Delhi, India, in accordance with the Arbitration and Conciliation Act, 2015.

17. International Users
For European Union (EU) Users
If you are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident.

United States Legal Compliance
If you are accessing the Service from the United States, you represent and warrant that (i) you are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) you are not listed on any United States government list of prohibited or restricted parties.

18. Severability and Waiver
Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver
Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

19. Translation Interpretation
These Terms and Conditions may have been translated if we have made them available to you in languages other than English. You agree that the original English text shall prevail in the case of a dispute.

20. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

21. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be notified at least 30 days in advance. Continued use of the Service after changes constitutes acceptance of the new Terms.
